Kenya’s High Court has temporarily halted construction of a multi-million shilling affordable housing project on a 58-acre historical shrine in Githunguri, pending a petition challenging the development.

The suspension order was issued on Thursday, April 2, by the Environment and Land Court in Thika, which cited concerns over the lack of public participation in the planning and approval process. The matter is scheduled for mention on July 6, 2026.

The petition was filed by the Agikuyu Council of Elders, joined by a coalition of community groups opposing the project, who argue that the government ignored local residents and cultural stakeholders before launching the housing plan.

At the center of the legal battle is Githunguri Kia Wairera, a site sacred to the Kikuyu community. Elders maintain it is hallowed ground where at least 54 Mau Mau fighters were executed during the colonial era, making it a potent symbol of resistance, sacrifice, and cultural identity.

The government plans to build 2,180 affordable housing units on the site, a move the elders describe as an “outrageous decision” that threatens to erase a key cultural monument.

“Any destruction or alteration of this land would amount to desecration of a place sacred to the Agikuyu people and their struggle for self-determination,” the petitioners stated in court documents.

The site’s historical significance stretches back to the 1930s when Agikuyu age groups established it as an indigenous institution of learning, which later became home to one of Kenya’s earliest girls’ dormitories.
